COLLATERAL (from Med. See also:Lat. collateralis,—cum, with, and latus, lateris, See also:side,—side by side, hence parallel or additional) , a See also:term used in See also:law in several senses. Collateral relationship means the relationship between persons who are descended from the same stock or ancestor, but in a different See also:line; as opposed to lineal, which is the relationship between ascendants and descendants in a See also:direct line, as between See also:father and son, grandfather and See also:grandson. A collateral agreement is an agreement made contemporaneously with a written See also:contract as See also:part of the transaction, but without being incorporated with it. Collateral facts, in See also:evidence, are those facts which do not See also:bear directly on the matters in dispute. Collateral See also:security is an additional security for the better safety of the mortgagee, i.e. See also:property or right of See also:action deposited to secure the fulfilment of an See also:obligation.
