For a See also:short See also:time during the See also:War of 1812 against See also:Great See also:Britain, he was See also:captain in the Third South Carolina See also:Regiment. He was a member of the See also:lower See also:house of the See also:state legislature from 1814 to 1818, serving as See also:speaker in the latter See also:year; was See also:attorney-See also:general of the state from 1818 to 1822, and in 1823 was elected, as a Democrat, to the See also:United States See also:Senate. Here he was conspicuous as an ardent See also:free-trader and an uncompromising See also:advocate of " States Rights," opposed the protectionist See also:tariff bills of 1824 and 1828, and consistently upheld the See also:doctrine that See also:slavery was a domestic institution and should be dealt with only by the individual states. In one of his speeches opposing the sending by the United States of representatives to the See also:Panama See also:Congress, he said, " The moment the federal See also:government shall make the unhallowed See also:attempt to interfere with the domestic concerns of the states, those states will consider themselves driven from the See also:Union." Hayne is best remembered, however, for his great debate with See also:Daniel See also:Webster (q.v.) in See also:January 183o. The debate arose over the so-called " See also:Foote's See also:Resolution," introduced by Senator See also:Samuel A. Foote (1780–1846) of See also:Connecticut, calling for the restriction of the See also:sale of public lands to those already in the See also:market, but was concerned primarily with the relation to one another and the respect ive See also:powers of the federal government and the individual states, Hayne contending that the constitution was essentially a compact between the states, and the See also:national government and the states, and that any state might, at will, nullify any federal law which it considered to be in contravention of that compact. He vigorously opposed the tariff of 1832, was a member of the South Carolina See also:Nullification See also:Convention of November 1832, and reported the See also:ordinance of nullification passed by that See also:body on the 24th of November. Resigning from the Senate, he was See also:governor of the state from See also:December 1832 to December 1834, and as such took a strong stand against See also:President See also:Jackson, though he was more conservative than many of the nullificationists in the state. He was See also:intendant (See also:mayor) of Charleston, S.C., from 1835 to 1837, and was president of the See also:Louisville, See also:Cincinnati & Charleston railway from 1837 to 1839. He died at See also:Asheville, N.C., on the 24th of See also:September 1839.

Hamilton Hayne (183o–1886), was a poet of some distinction, and in 1878 published a See also:life of his See also:father. See See also:Theodore D. Jervey, Robert Y. Hayne and his Times (New See also:York, 1909).
